The RVG applies to the remuneration of lawyers insofar as the work is performed in Germany, in particular for court proceedings in Germany; as a rule, billing is based on the amount in dispute or the value of the matter, unless otherwise stipulated by law. Fee agreements are possible. For activities in Italy, mainly court proceedings, the agreed remuneration or, if still applicable, the Italian "Tariffa Forense" applies, which provides for the billing of each individual activity, partly according to fixed amounts, partly based on the value in dispute; fee agreements, including success-related ones, are possible.

The amount of the lawyer's remuneration is determined either by the German Lawyers' Fees Act (RVG) or by a remuneration agreement. Remuneration agreements are always possible instead of billing the statutory fees. However, the provisions of §§ 49b BRAO and 3a ff. RVG must be observed. In court proceedings, however, the statutory fees cannot be undercut by agreements. The agreement of a higher fee than the statutory remuneration is possible at any time.
Statutory fees:
The German Lawyers' Fees Act consists firstly of the legal text and additionally the schedule of fees. The legal text contains the general legal fee regulations, the schedule of fees contains the individual fee categories. In the areas of civil, administrative and social law, the fees are calculated according to the value of the matter. This system of remuneration, which is independent of expenditure, is intended to ensure so-called cross-subsidization. Mandates with a high value are intended to compensate financially for the relatively high amount of work involved in mandates with a low value. For property disputes arising from the client relationship up to a value of EUR 50,000.00, the arbitration board of the legal profession, Rauchstraße 26, 10787 Berlin, www.s-d-r.org is responsible. The law firm LEGALEde does not participate in dispute resolution proceedings before a consumer arbitration board. In the event of disputes between lawyers and their clients, there is also the possibility of out-of-court dispute resolution upon request at the bar association responsible for the respective lawyer in accordance with Section 73 (2) No. 3, (5) BRAO.
